These Terms of Service ("Terms") govern your use of the Mailavo platform and services operated by Mailavo, Inc. ("Mailavo," "we," "us"). By creating an account or using our services, you agree to these Terms. If you don't agree, please don't use the platform.
We've written these in plain language. The goal is that you actually understand what you're agreeing to.
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. Notify us immediately at support@mailavo.com if you suspect unauthorized access. You may not share accounts or create accounts on behalf of others without their knowledge.
You must be at least 18 years old and authorized to bind the organization you represent to these Terms.
Mailavo operates on a prepaid credit system. Credits are purchased in advance and used to pay for print costs, postage, and processing fees as jobs are confirmed. Credits are non-refundable except at Mailavo's sole discretion. Unused credits do not expire and carry over indefinitely.
USPS postage is billed at the actual presorted rate determined at the time of job submission. Postage costs are shown before you confirm any job. Once a job is confirmed and submitted to a print partner, the credits are debited and the job cannot be cancelled without contacting support.
Credit card purchases are subject to Stripe's 2.9% + $0.30 processing fee. ACH transfers are not subject to additional processing fees — the full amount is applied to your credit balance.
You may use Mailavo to send legally compliant direct mail within the limits of the platform's capabilities. You may not use Mailavo to:
We reserve the right to suspend or terminate accounts that violate this section without notice or refund.
We work hard to keep Mailavo available, but we make no guarantees about uptime. We may perform scheduled maintenance and will try to give advance notice. We are not responsible for delays caused by USPS processing times, print partner capacity issues, or events outside our control (weather, carrier outages, etc.).
Turnaround SLAs (48, 72, or 96 hours, depending on your plan) are goals, not guarantees. We will work with you to resolve any SLA failures, but delays do not entitle you to a refund of credits already used.
You retain ownership of all data you upload to Mailavo, including PDF files and address data. You grant us a limited license to process that data solely to provide the services described. We do not sell your data, use it for advertising, or share it beyond what's described in our Privacy Policy.
You represent that you have the right to upload and mail to any address data you submit, and that your use of that data complies with all applicable privacy laws.
Print partners are independent businesses, not Mailavo employees or agents. Mailavo routes jobs to print partners and facilitates payment, but we do not directly control print quality, fulfillment timing, or any aspect of the physical printing and mailing process. We maintain quality standards for our partner network and will work to resolve issues when they arise.
To the maximum extent permitted by law, Mailavo's liability to you for any cause — regardless of the form of action — is limited to the amount of credits you purchased in the three months preceding the event giving rise to the claim.
Mailavo is not liable for indirect, incidental, consequential, or punitive damages, including lost profits, loss of data, or business interruption, even if we've been advised of the possibility of such damages.
You may close your account at any time through your account settings. We may suspend or terminate your account for violations of these Terms, at our discretion, with or without notice. Upon termination, your access to the platform ends. Remaining credits are non-refundable unless required by applicable law.
We may update these Terms from time to time. Material changes will be communicated by email and by updating the "Last updated" date on this page. Continued use of Mailavo after the effective date of an update constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the state of Delaware, without regard to its conflict-of-law provisions. Any disputes will be resolved in the state or federal courts located in Delaware.
